1. Acceptance of Terms
By accessing or using Miyagi ("Service"), operated at miyagi.app, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.
2. Description of Service
Miyagi is a lightweight feedback widget service designed for SaaS applications and websites. The Service enables you to:
- Collect bug reports, feature requests, and general feedback from your users
- Capture optional screenshots and device context (browser, OS, screen size)
- Manage and analyze feedback through a web dashboard
- Receive notifications via email and Slack integrations
- Export feedback data as CSV
3. User Accounts
To use our Service, you must create an account using Google OAuth. You are responsible for:
- Maintaining the security of your Google account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use
- Ensuring your use complies with Google's Terms of Service
4. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or in violation of any laws
- Collect sensitive personal data (health, financial, etc.) without proper consent and security measures
- Distribute malware, spam, or harmful content through the widget
- Attempt to gain unauthorized access to our systems or other users' data
- Reverse engineer, decompile, or attempt to extract the source code of the widget
- Resell, redistribute, or white-label the Service without written permission
- Use the Service in a way that could damage, disable, or impair it
5. Subscription Plans and Pricing
Miyagi offers the following subscription tiers:
- Free Plan: 50 feedback submissions per month, 1 project, email notifications, "Powered by Miyagi" badge
- Pro Plan ($5/month): 1,000 feedback submissions per month, 5 projects, Slack integration, remove branding, priority support
- Enterprise: Custom limits, custom branding, API access, dedicated support
Paid subscriptions are billed monthly in advance via Stripe. All fees are non-refundable except as required by law or as described in our 14-day money-back guarantee for first-time subscribers.
6. Intellectual Property
The Miyagi Service, including its widget code, dashboard, branding, and documentation, is owned by Miyagi and protected by intellectual property laws. You may not copy, modify, or create derivative works without permission.
7. Your Data
You retain full ownership of all feedback data collected through the Service. We do not sell, share, or use your data for any purpose other than providing the Service. You may export your data as CSV at any time and request complete deletion upon account termination.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects availability and will provide reasonable notice when possible. The Service is provided on an "as is" basis.
10. Limitation of Liability
To the maximum extent permitted by law, Miyagi and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
12. Termination
We may terminate or suspend your account at any time for violation of these Terms or for any other reason with reasonable notice. You may cancel your account at any time through the dashboard settings. Upon termination, your data will be retained for 30 days before permanent deletion unless you request immediate deletion.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of significant changes via email or through the dashboard. Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
